Welcome to the “My Esim” mobile application and the website https://myesim.gr (hereinafter the “App” or the “Website”). These Terms & Conditions (“Terms”) govern your access to and use of the services provided by Digital Growth Solutions LLC, located at 30N Gould St, Sheridan – WY 82801, Sheridan County, Wyoming, USA (the “Company,” “we,” or “us”). Any reference to “you,” “your,” or “User” refers to the individual who uses the App/Website.

By accessing or using the App/Website, you confirm that you have read, understood, and agree to these Terms. If you do not agree with any part of these Terms, please do not use our services.

  1. Description of Services
  1. Through the “My Esim” App/Website, the Company resells and provides eSIM data packages for international use/roaming in numerous countries.
  2. Each package’s availability, validity, and data limits are described in the App/Website prior to purchase.
  3. We partner with leading local network providers. However, we assume no responsibility for interruptions, delays, or technical issues that are solely attributable to third-party networks.
  1. User Account & Registration
  1. To purchase an eSIM, you may be required to create an account by providing accurate personal information (name, surname, email, and mobile phone).
  2. You are responsible for ensuring that the information you submit is correct and up to date.
  1. Device Responsibility & eSIM Activation
  1. You acknowledge and accept that you are solely responsible for having an eSIM-compatible device properly configured and/or unlocked by your carrier.
  2. The Company is not liable if you cannot activate or use the eSIM due to an incompatible or faulty device.
  3. You must activate the eSIM according to our instructions and within the specified timeframe. Otherwise, the eSIM may expire without any entitlement to refund or reactivation.
  1. Financial Terms & Payments
  1. Payment via Stripe: Transactions are processed through Stripe. You will be charged the price in Euros. If your card is in a different currency, any conversion fees are your sole responsibility.
  2. Receipt: A retail receipt is issued upon completion of purchase. No additional VAT or taxes apply.
  3. The Company may modify prices or packages at any time, but such changes will not affect purchases already completed.
  1. Cancellation & Refund Policy

The Company’s cancellation/refund policy aligns with Airalo’s, with the following adaptations/clarifications:

  1. Refund Request: You may request a refund within 30 days of the purchase date only if the eSIM does not function due to the Company’s fault (e.g., system error).
  2. Resolution Period: The Company has 10 days to troubleshoot or resolve the issue, in collaboration with you. You must cooperate (provide information, screenshots, etc.). If the problem is not resolved within this timeframe, the Company will issue a full refund.
  3. Exclusions – No Liability: No refund will be granted if:
    1. The eSIM fails to work due to local network problems or outages beyond the Company’s control.
    2. You use an incompatible device or fail to follow activation instructions.
    3. The package validity period has expired, and you did not use the data in time.
    4. Accidental purchases or partially used eSIMs that have been activated.
  4. Cancellation Before Activation: If you cancel before installing/activating the eSIM, generally no refund applies unless a documented system error on the Company’s side is proven.
  5. Right of Withdrawal for Digital Content: Under European law, once the eSIM is activated, you acknowledge that you waive any right of withdrawal for digital content since the service is considered fully performed.
  1. Acceptable Use & Violation Management
  1. Lawful Use: You shall not use the eSIM for any illegal or fraudulent purposes. You must not exceed the data limits or engage in spam, hacking, or any unlawful activity.
  2. Service Suspension: The Company reserves the right to suspend or terminate your access if you violate these Terms or acceptable use policies. In such a case, no compensation is due.
  3. Indemnification: You agree to indemnify and hold the Company, its officers, and employees harmless from any claim, damages, or expenses arising from your violation of these Terms or unlawful use of the service.
  1. Disclaimer & Limitation of Liability
  1. “As Is” Basis: The services are provided on an “as is” and “as available” basis, without any warranty of uninterrupted or error-free operation.
  2. Network Issues: The Company makes no guarantee that local networks will be available 24/7 or free from delays or disruptions.
  3. No Consequential Damages: To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages (e.g., loss of profits, data, etc.).
  4. Liability Cap: In any event, the Company’s total liability is limited to the amount you paid for the applicable eSIM package.
  1. Right to Modify Services/Terms
  1. The Company reserves the right to modify, suspend, or discontinue any part of the Service at its sole discretion, including adding or removing features.
  2. These Terms may be amended at any time. Changes take effect immediately upon being posted on the App/Website. Your continued use of the Service thereafter constitutes acceptance of the modified Terms.
  1. International Use & Restrictions
  1. You are responsible for complying with any local laws in the country where you use the eSIM. Certain countries may impose restrictions or prohibitions on eSIM or roaming services.
  2. The Company is not liable if your usage of the service violates local regulations or laws.
  1. Personal Data & Privacy
  1. The Company collects personal data (name, surname, email, phone) in compliance with the GDPR and applicable law.
  2. Such data is used for processing purchases, issuing and managing eSIMs, and communicating with you. If requested, you may receive newsletters or offers, with the option to opt-out at any time.
  3. The Company shares data only with third-party providers (Stripe) when necessary to process transactions or as described in our Privacy Policy.
  1. Governing Law & Dispute Resolution
  1. These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA.
  2. Any dispute arising out of or relating to these Terms shall preferably be settled amicably. If an amicable resolution is not reached, the courts of Wyoming shall have jurisdiction.
  1. Language – Prevalence of English Text
  1. These Terms are provided in both Greek and English. In the event of any inconsistency, the English version shall prevail.
