MYESIM REFERRAL PROGRAM & MONTHLY GIVEAWAY TERMS AND CONDITIONS

1. ORGANIZER

The “Refer & Win” promotional program is organized by DIGITAL GROWTH SOLUTIONS LLC, located at 30N Gould St, Sheridan, WY 82801, Sheridan County, Wyoming, United States, EIN: 33-1308673 (hereinafter referred to as the “Company” or “MyESIM”).

2. ELIGIBILITY

Participation is open to natural persons who are at least eighteen (18) years old, regardless of their country of residence.

The following persons are excluded from participation:

  • Employees of the Company.
  • Spouses and first- or second-degree relatives of Company employees.
  • Persons acting on behalf of the Company or any affiliated entity.

3. PROGRAM DESCRIPTION

Each registered MyESIM user receives a unique personal referral code.

Users may share their referral code with third parties.

New users who apply the referral code during their first purchase receive a ten percent (10%) discount on their first order.

For each successful referral, the referring user receives one (1) entry into the monthly giveaway.

4. VALID REFERRALS

A referral shall be considered valid only if all of the following conditions are met:

  • The referred user has never previously completed a purchase through MyESIM.
  • The referred user successfully completes a paid eSIM order.
  • A valid referral code is applied during the purchase process.
  • The transaction is not canceled, refunded, flagged as suspicious, or determined to be fraudulent.

Each valid referral grants one (1) giveaway entry.

There is no maximum limit on the number of entries a participant may earn.

The Company reserves the right to revoke or invalidate entries if the related order is refunded, canceled, subject to a chargeback, identified as suspicious, or found to violate these Terms and Conditions. In such cases, the referral shall be deemed invalid and excluded from the monthly giveaway.

5. MONTHLY GIVEAWAY

The giveaway will take place on the first business day of each month and will include all valid referrals generated during the immediately preceding calendar month.

The winner selection process will be conducted using a certified Random Number Generator (RNG).

The following participants will be selected:

  • One (1) main winner.
  • Two (2) alternate winners.

Results will be announced within three (3) business days following the giveaway date.

6. PRIZES

Prizes may vary each month at the sole discretion of the Company.

Examples of prizes may include:

  • Travel packages.
  • Airline tickets.
  • Gift cards.
  • Free eSIM plans.
  • Products or services provided by partner companies.
  • Any other prize selected by the Company.

The Company reserves the right to replace any advertised prize with another prize of equal or greater value.

Prizes are non-transferable and may not be exchanged for cash or any other consideration unless otherwise determined by the Company.

7. WINNER NOTIFICATION

Winners will be notified via the email address associated with their MyESIM account.

The selected winner must respond within ten (10) calendar days from the date of notification.

If the winner fails to respond, cannot be contacted, or declines the prize, the Company reserves the right to award the prize to the first alternate winner and subsequently to the second alternate winner if necessary.

8. FRAUD PREVENTION AND ABUSE

The following actions are strictly prohibited:

  • Creating fake or multiple accounts.
  • Self-referrals.
  • Providing false or misleading information.
  • Artificially generating referrals.
  • Any activity intended to unfairly obtain giveaway entries.

The Company reserves the right to investigate any participation and invalidate entries, referrals, accounts, or prizes where fraudulent, abusive, deceptive, or unlawful conduct is reasonably suspected.

The Company may request additional identification or verification documents from any participant or winner where necessary to confirm eligibility or award a prize.

The Company further reserves the right to investigate and exclude referrals originating from the same device, payment method, credit card, debit card, payment account, IP address, or any other technical or commercial indicators that reasonably suggest self-referrals, duplicate accounts, coordinated abuse, or manipulation of the program.

The Company’s determination regarding the validity of any referral, entry, or participation shall be final and binding.

9. PUBLICITY

By accepting a prize, winners agree that MyESIM may publish their first name, the initial letter of their surname, and their city of residence through MyESIM communication channels.

Any additional publication of photographs, videos, testimonials, social media content, or promotional materials shall only occur with the winner’s prior consent.

10. PERSONAL DATA

Personal data collected in connection with this program shall be processed solely for the purposes of administering the referral program, conducting the giveaway, communicating with winners, and awarding prizes.

Data processing shall be carried out in accordance with applicable data protection laws and the MyESIM Privacy Policy.

Participants retain all rights available under applicable privacy legislation, including rights of access, correction, deletion, and restriction of processing where applicable.

11. LIMITATION OF LIABILITY

The Company shall not be liable for:

  • Technical failures, interruptions, or system malfunctions.
  • Delays or errors caused by third-party service providers.
  • Inability to participate due to connectivity, device, software, or network issues.
  • Delays in prize delivery caused by third-party suppliers or partners.
  • Any loss, damage, or expense arising from participation in or inability to participate in the program.

To the maximum extent permitted by applicable law, the Company’s liability shall be limited solely to the awarding of the applicable prize.

12. MODIFICATION OR TERMINATION

The Company reserves the right to modify, suspend, or terminate the referral program at any time for business, operational, technical, legal, or other legitimate reasons.

Any changes will be published through the MyESIM website and/or application and shall become effective upon publication unless otherwise specified.

13. ACCEPTANCE OF TERMS

Participation in the MyESIM “Refer & Win” program constitutes full, unconditional, and irrevocable acceptance of these Terms and Conditions.

Should any provision of these Terms and Conditions be deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms and Conditions constitute the complete agreement governing participation in the MyESIM “Refer & Win” referral program and monthly giveaway.
